Yapay Zekâ ve Uluslararası Hukukun Geleceği

Abstract

Yapay zekâ alanındaki gelişmeler ile birlikte ulusal ve uluslararası boyutta inanılmaz bir değişim yaşanmaktadır. Bu gelişmeler uluslararası hukuku da derinden etkileme potansiyeline sahiptir. Yapay zekâ ürünü bazı araç, silah ve akıllı cihaz uygulamaları bazı temel insan haklarını derinden etkilemiştir. Bu kapsamda otonom silahların kullanılmaya başlanması ile insancıl hukuk bağlamında sivillerin korunması ve yaşama hakkı daha fazla tehdit altına girmiştir. Yapay zekâ ile yapılan içerik kişiselleştirme ve filtre baloncuğu uygulamaları, ifade özgürlüğü için risk oluşturmaktadır. Yine güvenlik, sağlık, iş, online alışveriş gibi amaçlarla kullanılan çeşitli uygulamalarla kişisel verilerin elde edilmesi, kişisel verilerin korunması ve özel hayatın gizliliği gibi temel insan haklarını darmadağın etmiştir. Bu makalede öncelikle yapay zekânın olumlu ve olumsuz yönleri ele alınmaktadır. Daha sonra yapay zekânın etkilediği, yaşama hakkı, ifade özgürlüğü ve kişisel verilerin korunması / özel hayatın gizliliği hakları incelenmektedir. Ardından yapay zekâ konusunda çeşitli uluslararası kuruluşların hazırladığı rehber veya tavsiye kuralları üzerinde durulmaktadır.
